Settlement reached in Whistleblower case against the city of Long Branch claiming violations of New Jersey's Conscientious Employee Protection Act

A former city employee who claimed she was fired for acting as a whistleblower on official misconduct filed a complaint in April 2011.  Her specific accusations were that the city was in violation of New Jersey's Conscientious Employee Protection Act when it fired her for whistleblowing during her employment. The details of the settlement were not disclosed.

Between 1995 until her dismissal in 2011, the whistleblower served as the city's principal personnel clerk. She was barred from asserting several pieces of evidence if the case went to trial. The barred evidence included her claim the city fired her for cooperating with FBI agents conducting an investigation in 2005 during Operation Bid Rig.

Operation Bid Rig was the state's largest federal corruption sting, targeting dozens of politicians and officials in Monmouth and Ocean counties and elsewhere in the state.

A settlement has been reached in a whistleblower class action lawsuit brought against North Broward Hospital District who is accused of engaging in improper financial relationships with referring physicians.

The whistleblower will receive $12,045,655.51 from the recovery. 

The whistleblower case, filed in 2010, alleged that the hospital district provided compensation to nine employed physicians that exceeded the fair market value of their services.  The United States contended that these agreements violated the Stark Statute and the False Claims Act.  The Stark Statute restricts the financial relationships that hospitals may have with doctors who refer patients to them.

$1.9 Million Settlement reached in Whistleblower case with California-Based Masonry Companies

Settlement Amount:

A settlement has been reached in a whistleblower class action lawsuit brought against Frazier Masonry Corp, F-Y Inc, CTI Concrete & Masonry Inc, Masonry Technology Inc, Masonry Works Inc, Russell Frazier and Robert Yowell.  They are accused of misrepresenting their disadvantaged small business status in connection with military construction contracts.

The whistleblower will receive a $393,383 share of the recovery.

This settlement stems from other cases, the first of which was filed in 2012.  The United States alleged the defendant masonry subcontractors and their principals misrepresented to the prime contractors that they were small businesses, and that these misrepresentations caused the prime contractors to falsely certify that they had complied with the small business provisions of the contracts in claiming payment.  Russell Frazier previously pleaded guilty in related criminal proceedings to causing false statements.

$1.95 Million Settlement reached in Whistleblower case with CDI Corporation

A settlement has been reached in a whistleblower class action lawsuit brought against CDI Corporation who is accused of charging the military for work not actually performed. 

Under the terms of the settlement, the whistleblower will receive $360,750.

The whistleblower cae was originally filed in 2005. The United States alleged that CDI wrongfully charged labor costs to work orders under military aircraft engine contracts for The General Electric Company (GE). The civil investigation examined CDI’s labor and billing records from Jan. 15, 2001, to Dec. 31, 2006. The civil investigation found that during this time period, CDI directed the mischarging of employees’ labor costs to purchase orders that would be reimbursed by the U.S. military. In fact, the employees did not perform the work billed to those military projects. CDI entered these mischarged labor costs in increments of 0.5 hours or less to evade detection.

$67.5 Million Settlement reached to resolve False Claims Act Allegations against University of Phoenix

A settlement has been reached to resolve False Claims Act allegations against University of Phoenix who is accused of student recruitment policies that violated the False Claims Act.

The two whistleblowers will receive $19 million from the settlement.

This case began as a whistleblower action against another company. Though the United States did not intervene in this action, the Government provided support and assistance to the whistleblowers at many stages of the case.

$1.7 Million Settlement reached in Whistleblower case with Tampa Bay Doctor

A settlement has been reached in a whistleblower class action lawsuit brought against Dr. Gabriel DeCandido who is accused of defrauding the Medicare program.

According to the settlement, the court permitted the government to seize five of his vehicles and garnish $976,000 that Dr. DeCandido transferred to his wife.The whistleblower's share of the recovery is $306,000.

This case was originally filed by a whistleblower in January 2005.  The United States alleged Dr. DeCandido violated the False Claims Act by billing the Medicare program for higher levels of service than he actually rendered to patients and by billing for services not provided. The government presented sufficient evidence showing that Dr. DeCandido attempted to hide and transfer his assets to avoid having to pay a judgment to the United States.

$13.5 Million Settlement reached in Whistleblower case with NuVasive Inc

A settlement has been reached in a whistleblower class action lawsuit brought against NuVasive Inc who is accused of causing health care providers to submit false claims to Medicare and other federal health care programs.

According to the settlement agreement, the federal share of the civil settlement is $12,583,413.84, and the state Medicaid share of the civil settlement is $916,586.16. The whistleblower will receive a $2.2 million share of federal reward.

The whistleblower case was originally filed in September 2012.  The United States complaint alleged that between 2008 and 2013, NuVasive promoted the use of the CoRoent System for surgical uses that were not approved or cleared by the FDA, including for use in treating two complex spine deformities, severe scoliosis and severe spondylolisthesis.  As a result of this conduct, the United States alleged that NuVasive caused physicians and hospitals to submit false claims to federal health care programs for certain spine surgeries that were not eligible for reimbursement.  In more detail, the government complaint asserts NuVasive knowingly offered and paid illegal remuneration to certain physicians to induce them to use the CoRoent System in spine fusion surgeries, in violation of the federal Anti-Kickback Statute.  The illegal remuneration consisted of promotional speaker fees, honoraria and expenses relating to physicians’ attendance at events sponsored by a group known as the Society of Lateral Access Surgery (SOLAS).  SOLAS was allegedly created, funded and operated solely by NuVasive, despite its outward appearance of independence.
